Eric A. Cataldo was named Partner at Gilmartin Magence LLP in March of 2011 and joined the firm in May of 2001 as a law clerk. Born and raised in Rome, New York, he is a 1999 graduate of Boston College and a 2002 graduate of Suffolk University Law School.
Mr. Cataldo is admitted to practice in Massachusetts and concentrates his practice in condominium law and residential conveyancing. He represents developers in projects that range in size from two units to more than three hundred units, including projects involving complex mixed-use and multi-tier condominium regimes. He has coordinated the preparation of loan subordination agreements and tri-party escrow agreements, advised on compliance of architectural plans with Massachusetts condominium law, and drafted formal tenant notifications of condominium conversion as required by both Massachusetts law and local ordinances. Additionally, Mr. Cataldo is versed in issues related to developer turnover of control to homeowners in a condominium after sell-out of initial units, management and operations of condominiums including drafting of amendments to rules and regulations and by-laws, and compliance of condominium legal documents with secondary market lending regulations. In 2016, Mr. Cataldo co-authored a model 2-unit Condominium Declaration of Trust adopted by the Real Estate Bar Association of Massachusetts and spoke on a panel at the annual conference for the Bar that same year to announce the creation of the form and explain its purpose. On the residential conveyancing side of his practice, he represents buyers and sellers in purchase and sale negotiations and he represents lenders in all aspects of residential real estate closings from title clearing through post-closing matters.
